Agreement to official Giveaway rules

By participating, Entrants agree to abide by and be bound by these Official Giveaway Rules (“Rules”) and the Terms and Conditions (“Terms”) set forth below, which are final and binding in all matters relating to the Giveaway.  Winning a prize is contingent upon fulfilling all requirements set forth herein. Sponsor reserves the right to interpret and apply these Rules and Terms in its sole discretion and to modify or terminate the Giveaway at any time.

No purchase is necessary; a purchase will not increase your chances of winning.

Terms and conditions

Who may enter

The Giveaway is open only to legal residents of Australia who are 18 years of age or older at the time of entry.  Employees of Sponsor, or of its affiliates or subsidiaries, and their immediate family members (spouses, children, parents, siblings, and the spouses of children, parents, and siblings, regardless of where they live) or persons living in the households of such individuals, whether or not related, are not eligible to enter or win a prize. THE GIVEAWAY IS VOID OUTSIDE OF AUSTRALIA, AND WHERE PROHIBITED BY LAW.

How to enter

Giveaway Period: The Giveaway Period starts 09:00 am on October 2 2023 Australian Eastern Standard Time and closes at 23:59 on November 6 2023. Sponsor controls the official time-keeping device for the Giveaway. To enter the Giveaway, go to the Giveaway landing page and enter your name, phone number, and email to receive one entry into the draw.  Entrant agrees to receive marketing communications from Sponsor. Limit one entry per person/per phone number, per Giveaway Period.  You may not enter multiple times using multiple phone numbers or email addresses.  No robotic, programmed, script, macro or other automated entries (collectively “automated entries”) are permitted.  Automated entries, or multiple entries by the same person/phone number, will be disqualified. Any questions, comments or complaints regarding this Giveaway shall be directed to Sponsor.  By entering you agree to these Official Rules. The Sponsor is not responsible for late, misdirected, or delayed entries.  No mechanical reproductions or facsimiles of entries allowed.  All entries become the exclusive property of Sponsor and will not be acknowledged or returned.

Contest prizes

If you are randomly selected as a prize winner during the entry period, you will receive one (1) Ultimate Pilates Bundle containing some or all of the following items:

The total prize pool is worth approximately $3000 AUD based on the recommended retail value and the exchange rates at the time of printing. The Sponsor accepts no responsibility for any variation in the value of the prizes.

Each prize must be taken as stated and no compensation will be payable if a winner is unable to use the prize as stated. Prizes are not exchangeable or redeemable for cash or other goods or services. A prize cannot be assigned to any other person, unless agreed to by the Sponsor. It is a condition of accepting a prize that the winner accepts the conditions of use of that prize.

If the prize (or part thereof) is unavailable, the Sponsor, in its discretion, reserves the right to substitute a prize (or part thereof) of equal or greater value for the prize (or part thereof) that is unavailable, subject to any written directions from a regulatory authority.

The delivery of the prize will be determined by the Sponsor. The prize will be sent to a TNT depot chosen by the Sponsor. The winner will be responsible for organsing collection of the prize from the TNT depot. The Sponsor accepts no responsibility for shipping and freight costs.

Drawing and notification

Prize winner will be selected in a random drawing from among all entries received during the Giveaway Period. The drawing will take place at on November 13 2023 at the offices of the Sponsor or a party acting on its behalf, whose decisions are final and binding in all matters relating to this Giveaway. The winners will be notified by email. The Sponsor will notify the Entrant via email by November 20 2023. The Entrant will then need to reply to the email sent by the Sponsor agreeing to claim the prize. If the winner has not replied by email within (72) hours of the Sponsor's email, the prize will be forfeited. No liability is assumed for any notification that is lost, intercepted or not received by a potential Winner for any reason.  Odds of winning the drawing will depend on the total number of eligible Entries received during the Giveaway period. 

Release and limitations of liability. By participating in the Giveaway, Entrants agree to release and hold harmless the Sponsor, its respective officers, directors, employees, agents, subsidiaries, affiliates, distributors, sales representatives, advertising and promotional agencies from any causes of action arising out of participation in the Giveaway or receipt or use of any Prize, including, but not limited to: (a) any technical errors that may prevent an Entrant from submitting an entry; (b) unauthorized human intervention in the Giveaway; (c) printing errors; (d) lost, late, postage-due, misdirected, or undeliverable mail; (e) errors, technical or otherwise, in the administration of the Giveaway or the processing of entries; or (f) injury, death, or damages (including punitive, consequential, direct or indirect) to persons or property which may be caused, directly or indirectly, in whole or in part, from the Entrant’s participation in the Giveaway or receipt or use or misuse of any prize. Released Parties assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries.

Dispute Resolution. Except where prohibited, you agree that any and all disputes, claims and causes of action arising out of, or connected with, the Giveaway or any Prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Australia.  All issues and questions concerning the construction, validity, interpretation and enforceability of these Rules, your rights and obligations, or the rights and obligations of Sponsor in connection with the Giveaway, shall be governed by, and construed in accordance with the laws of Australia without giving effect to any choice of law or conflict of law rules (whether of Australia or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than Australia.
